1. Acceptance of Terms

By accessing or using Taifa Chat or Taifa Merchants (together, the "Services"), operated by TaifaPay Limited ("TaifaPay", "we", "us"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Services.

2. Description of Services

Taifa Chat provides peer-to-peer money transfer, bill-splitting, payment requests, and cash-out to M-Pesa or bank accounts within a chat interface. Taifa Merchants provides payment collection via M-Pesa, card schemes and Pesalink, and payout/disbursement to merchants' preferred accounts.

3. Eligibility & Accounts

You must be at least 18 years old and capable of entering a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Fees

Certain transactions, including cash-out, card collection, and cross-channel payouts, may incur fees. Applicable fees will be disclosed to you before you confirm a transaction.

5. User Responsibilities

You agree to use the Services only for lawful purposes, to provide accurate information, and not to use the Services for fraud, money laundering, or any prohibited transaction under Kenyan law.

6. Liability & Disclaimers

While we take commercially reasonable steps to keep the Services secure and available, TaifaPay is not liable for losses arising from unauthorized account access caused by your failure to safeguard credentials, or from outages of third-party payment rails (including M-Pesa, Pesalink, or card networks) beyond our control.

7. Data & Privacy

We collect and process personal and transaction data as needed to provide the Services, in accordance with applicable Kenyan data protection law. We do not sell your personal data to third parties.

8. Termination

We may suspend or terminate access to the Services if these Terms are violated, or if required by law or our regulators, with notice where reasonably possible.

9. Governing Law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
